PRIVACY POLICY
At Bajaj Auto Limited (hereinafter referred to as “We”, “Us”, “Company”, “Our”, “Bajaj Auto Limited”, “CTL”, “Bajaj Auto Limited”, or “BAL”), privacy of individuals is of primary importance & we take care in handling any personal data we collect from customers, users or visitors (hereinafter referred to as “You”, “Your”, “customer”, “user”, “visitor”). We set out below our Privacy Notice that applies to Chetak Mobile Applications (hereinafter referred to as the “App” or “Application”), websites - chetak.com/en-np and bajajauto.com/en-np, online purchase portal, associated sub-domains and web pages including but not limited to social media pages; (hereinafter collectively or individually, as the case may be, referred to as “Websites” or “Platform”).
This Privacy Notice also applies to the personal data processed during your usage of the electric vehicle 'Chetak’.
This Privacy Notice is an electronic record as per the Electronic Transactions Act, 2008 in the form of an electronic record being compliant and construed as per the data protection laws of Nepal including but not limited to, the Individual Privacy Act, 2018 (the “Privacy Act”) and the Individual Privacy Regulations 2020 (“Privacy Regulations”). Where this Privacy Notice may use terms defined in the Privacy Act, those terms shall have the same meaning as the Privacy Act. This Privacy Notice shall be enforceable in the same manner as any other written agreement between you and the Company.
This Privacy Notice should be read together with our Platform’s terms of use (the “Terms of Use”). For your benefit and protection, please carefully read and accept these documents before using the Platform. Your use of the Platform and the handling of your personal data will be governed by this Privacy Notice, along with all applicable policies, notices, guidelines, additional terms and disclaimers that are published and shared with you from time to time.
1. General
1.1. By using the Platform or Website and voluntarily providing us with your data (personal and/or non-personal), either directly or through third parties, you agree to our use/handling of your personal data as outlined in this Privacy Notice. If you do not agree and consent to the terms and conditions of this Privacy Notice, you should refrain from using the Platform.
1.2. Permission to grant access or continued use of our Websites/Platform shall amount to your consent. Without your personal data, we may not be able to perform contractual obligations nor be able to comply with legal obligations.

3. Detailed description of personal data and purposes
3.1. Account information:We may collect personal data when you register and create an ‘Account’ and avail Services available through the Platform. This information may include name, profile pictures, email address, contact number, identity proof (through acceptable documentation such as any government-issued identity documents), driving license documentation, and financial information. We may also collect vehicle owner information including but not limited to vehicle registration details, chassis/engine numbers, and any other information as may be required to create the Account.
3.2. Personal data shared by third parties:We may receive your personal data from third parties (for example local dealers) per the privacy notice of such third-party service providers. Such data received from the third parties may include, but is not limited to; username, profile picture, email address, any data that has been made public or any other data that the third party has a right to share with us. By creating an Account via a third-party service provider, you authorize and hereby grant your express consent for the Company to collect and use such data per this Privacy Notice.
3.3. Payments:: In the event you make payments on the Platform via a payment gateway to complete any financial transaction, we may collect and store your credit card, debit card, bank account number and other financial information per applicable law. You acknowledge that the payment gateway may be provided by a third-party service provider, in which case the applicable terms and use and privacy policy of such service provider shall be applicable.
3.4. Location and vehicle data:To be able to provide certain vehicle-specific features, we need to collect location data of your vehicle and by extension your location. We may further obtain data related to the vehicle, including without limitation, type of the vehicle, model number of the vehicle, battery data, vehicle faults, vehicle identification number (VIN), any other vehicle data, and driving behaviour, as may be required for the Company to be able to provide any vehicle specific features/services.
3.5. Phone-related data: To provide you with features such as Maps, Trip Details, GeoFence, Anti-theft alerts, Unauthorized Vehicle Movement Alerts, Emergency Contact, Bluetooth, Music, Messages, and Call Management, certain permissions may be required. These permissions may be requested through your phone to access your phonebook, contacts, device location, messages, call-related data, inventory of other apps on your device, microphone, camera, and other sensitive device or usage data.
3.6. Cookies: We use cookies and/or similar in-house and third-party tracking tools to track user traffic patterns. Tracking tools also used are beacons, tags and scripts to collect and track information and to improve and analyse our Website/Platform. We may collect personal data in the form of log data such as the IP address of your computer/proxy server that you use to access the Internet, your device type, operating system type, mobile device identifier, browser type, domain, and other system settings, the name of your ISP or mobile carrier etc. You may choose to disable the cookies through your browser or device settings.
3.7. Submission of forms: Any personal data you submit through online forms in different sections of the Platform is used solely for the intended purpose specific to that section. Depending on the form and activity, such data may be shared with our associated companies, distributors, partners, dealer networks, authorized third-party service providers, agencies or vendors (such as insurers, financiers, local distributors etc.). By choosing such additional services/activities and submitting the forms, you consent and hereby authorize the sharing of respective personal data with third parties.
3.8. Communications:By providing your contact details over the Platform or any other mode (via dealers, events, test drives. etc.), you consent to receive communication from us over email, messages, phone calls and/or any other communication channels you provide or accept.
3.9. Customizations and safety: We use the data for various purposes including but not limited to account creation, serving customized/personalized content, providing information regarding features and taking action regarding unlawful or harmful activities. We may use your email address or phone number to notify you about platform updates, system maintenance, outages, account issues, or troubleshooting problems.
3.10. Analytics:As a part of enhancing our Platforms & providing a better visitor experience for users, visitors, and customers, we analyse the use of our content in terms of content requested or downloaded and the number of visits or hits. Data collected during this process is only used for identifying improvement possibilities and does not cater to any other purposes.
3.11 App-related purposes: We, or third parties authorized by us, may use the personal data obtained via the App as set out below:
- a. To create your Account and to support the use of our App.
- b. To notify you about your account, troubleshoot account-related issues, resolve disputes, and verify your identity to ensure your eligibility to use the App.
- c. To inform you about updates or changes to the App.
- d. To comply with legal and regulatory obligations.
- e. To track vehicle status and generate alerts for users based on battery-related data, such as State of Charge (SoC) and State of Health (SoH), to help maintain the vehicle’s condition.
- f. To conduct ‘Battery Authentication’ if applicable to you.
3.12. Purposes related to rendering services: Further we may use your personal data, vehicle data, or other non-personal data sets related to your usage of the vehicle or Platform for the following purposes:
- a. to provide you with our Services (as defined in the applicable Terms of Use);>
- b. to inform you about our Services and to respond to your requests;
- c. for the creation or development of business intelligence or data analytics concerning the services and vehicles/products provided by us;
- d. to provide you with a better experience when you access our Platform, use our vehicles/products and improve the Services and vehicles/products or for further research and development purposes;
- e. to comply with our legal or statutory obligations.
4. Obligations for transfer/sale of vehicle
In the event of the transfer/ sale of the vehicle, you will ensure that the vehicle is transferred to the buyer and that the relevant records in connection with the owner of the transferred/sold vehicle are updated with the relevant authorities of Nepal. You must update the registered mobile number or account details used at the time of vehicle purchase from the distributor, dealer, transferor, or vendor. Additionally, when transferring ownership, you must change the mobile number associated with your account in the App and the distributor/dealer's records to the buyer’s mobile number. Otherwise, you will bear responsibility or liability for any claims made by the buyer of the vehicle.
5. Transfer of personal data outside Nepal
Any personal data you provide to the Company may be processed, collected, used, disclosed, and transferred to countries outside Nepal.
6. Disclosure of data
You hereby consent to the Company disclosing your data to third parties in good faith whenever such disclosure/action is necessary:
- a. To comply with a legal obligation or if the disclosure was required by law, rule or regulation or was in response to a valid order of court or authorized agency of government or other legal process.
- b. To perform contractual obligations to which the User is a party, or to take steps at the request of the User before entering into a contract;
- c. To protect and defend the legal rights or intellectual property rights, reputation or other properties of the Company;
- d. To prevent or investigate possible wrongdoing in connection with the Platform;
- e. To protect the personal safety of users of the Platform or the public; and
- f. To protect against any legal liability.
7. Data security
7.1. We use reasonable safeguards as required by law to protect and preserve the integrity and security of your data against unauthorized access, loss, theft, unauthorised, reproduction, use or amendment, disclosure or destruction of data. We use reasonable security practices and procedures. Whilst we strive to protect your Personal Data, we cannot ensure or warrant 100% security of any data that you send to us, and you do so at your own risk. You accept the inherent security implications of data transmission over telecommunication networks, such as satellite, mobile data and cellular, including Wi-Fi, and the internet; and agree that data transmitted through such telecommunication medium cannot always be guaranteed as completely secure. You agree that your use of the Platform will be at your own risk.
7.2. As a registered user with an Account, you are responsible for keeping your authentication details (e.g.: OTP or passwords) received at the time of login confidential.
7.3. You are requested to immediately report any security violations to us via privacy@bajajauto.co.in.
7.4. Notwithstanding anything contained in this Privacy Notice or elsewhere, to the fullest extent permitted by applicable law, the Company shall not be held responsible for any loss, damage or misuse of the data provided by you or the data gathered from your use of the App.
7.5. Phishing or false emails/SMS: If you receive an email or SMS claiming to be from the Company that requests personal data (such as your credit card details, login credentials, or password) or asks you to verify your account by clicking on a link, it is likely a fraudulent attempt to obtain your information unlawfully. 8. Links to other sites
The Platforms may contain links to other websites, other domains, web pages, applications, widgets, or blogs of third-party service providers over which we have no control, e.g., methods of distribution of Chetak vehicles and handling issues related to privacy (hereinafter referred to as "Other Sites"). We are not responsible for Other Sites’ handling of personal data.
If you click on a third-party link from our Platform, you will be redirected to that third party’s website. The fact that we link to any third-party Other Sites or present an advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of any such third party’s privacy or data security policies or practices. We are not responsible for the privacy policies or practices or any breaches by the Other Sites that you may access from the Platform.
9. Updates to the “Privacy Notice”
We may update this Privacy Notice from time to time. You must periodically review the Privacy Notice as available on Platforms for the latest information on our privacy practices. In the event you continue to use the Platform after any update in the Privacy Notice, your use of the Platform and processing of your personal data shall be subject to the updated Privacy Notice.
10. Governing law
This Privacy Notice is governed by the laws of Nepal. You hereby consent to the exclusive jurisdiction and venue of Nepal courts, in all disputes arising out of or relating to the use of the Platform, to the fullest extent permitted by the laws of any jurisdiction which may apply to the matters and disputes and without prejudice to mandatory conciliation procedures. Use of the Platforms is unauthorized in any jurisdiction that does not give effect to all provisions of the terms set out herein, including without limitation this paragraph.
